Most of us are familiar with the phrase "No Win No Fee" but not everybody understands exactly what this means.

What is No Win No Fee

No Win No Fee is the common term used for what is known as a Conditional Fee Arrangement.  In England and Wales this essentially means that the lawyer representing your case will only get paid if they are successful in winning compensation for you.  The lawyer could also get a success fee.  Both of these fees are generally paid by the losing party which means that you get 100% of any compensation settlement.

So how do the solicitors get paid?

One of the most common questions people ask about No Win No Fee is how do the solicitors get paid when I'm not paying them anything? When the solicitor handling your case wins compensation for you, they get their legal fees paid for by the other party involved including any additional success fee that may be awarded - this leaves you with 100% of your compensation settlement.  If the case is unsuccessful then your solicitor will not get paid anything.  The winning side will of course be entitled to their costs but your solicitor will be able to arrange insurance to cover this event.  This is commonly known as After the Event Insurance. Either way, a claim handled on a No Win No Fee arrangement means that you will not pay out any legal costs regardless of the outcome.
